1. Agreement to Terms

We provide statistical consulting, data analysis, research design, and monitoring and evaluation services. All services are performed with professional skill and care and are subject to the specifics outlined in your service agreement or confirmed Order.

Our services include but are not limited to:

• Research study design and methodology development
• Survey design and questionnaire development
• Data cleaning and preparation
• Monitoring and evaluation framework development
• Academic and research paper writing support

4. User Accounts and Security

To access certain features, you must create an account. You agree to provide information that is accurate, complete, and current. You are solely responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5. Orders, Payments, and Refunds

When you place an Order, you agree to provide current, complete, and accurate information. We reserve the right to refuse any Order. All payments are due upon acceptance of our quote before work commences. If payment is not received, we reserve the right to cancel the Order.

Due to the nature of our services, refunds are issued at our sole discretion. A refund may be considered if the delivered work is proven to not meet the agreed-upon requirements of the Order, and we are unable to rectify it. All refund requests must be submitted in writing within 14 days of delivery of the final work.

6. Client Responsibilities

You agree to provide all necessary data, materials, and information required for us to perform the Services. You guarantee the correctness and completeness of all information provided. Delays or failures in providing such information may result in a revised timeline and/or additional costs.

You are responsible for:

• Providing accurate and complete information for your project
• Ensuring you have appropriate rights to all data shared with us
• Reviewing and providing feedback on deliverables in a timely manner
• Making payments according to the agreed schedule

7. Intellectual Property

The website, its original content, features, and functionality are the exclusive property of Bright Experts Statistics Services. Upon receipt of full payment for an Order, the Client is granted a worldwide, non-exclusive, non-transferable license to use the final Deliverables for their intended business or academic purpose. We retain the right to use the methodologies and general knowledge gained during the project for other purposes.

All pre-existing intellectual property belonging to either party shall remain the property of that party. We retain ownership of all tools, methodologies, processes, and technologies used to provide the Services.

8. Confidentiality

Both parties agree to keep all non-public information received from the other party confidential. This includes business strategies, client lists, and any proprietary data. This information will not be disclosed to any third party without prior written consent, except as required by law.

We implement appropriate technical and organizational measures to ensure the security and confidentiality of your data. All employees and contractors are bound by confidentiality agreements.

9. Limitation of Liability

In no event shall Bright Experts Statistics Services be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, resulting from your use of the Service or Deliverables. Our total liability for any claim arising out of or relating to our Services shall not exceed the total fees paid by you for the specific Order giving rise to the claim.

We are not liable for any delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, embargoes, government regulations, or other disasters.

10. Termination

We reserve the right to suspend or terminate your account and access to our Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through amicable negotiation. If a resolution is not reached within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the courts of Kenya.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the new terms on this page.
